Agreement to Terms

By accessing or using ARKA AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Account Registration

To use our Service, you must:

• Be at least 13 years of age (or 16 in the European Economic Area)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities under your account

You may not share your account credentials or allow others to access your account. You are responsible for maintaining the confidentiality of your password.

Service Plans and Billing

Free Tier

• Includes 10,000 tokens per month
• Limited to GPT-4o-mini model
• 15,000 token hard cap
• 50 requests per day maximum
• Access to all presets

Paid Plans

Paid plans (Starter, Pro, Agency) include:

• Monthly token allocation as specified in your plan
• Automatic overage billing at approximately $0.01 per 1,000 tokens
• $200 per month overage safety cap to protect against runaway charges
• Access to all AI models and features
• Priority support

Payment Terms

• Payments are processed through Stripe
• Subscriptions are billed monthly in advance
• Overage charges are billed at the end of each billing cycle
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice
• Failed payments may result in service suspension

Acceptable Use Policy

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate harmful, abusive, or illegal content
• Harass, threaten, or harm others
• Spread misinformation or spam
• Attempt to circumvent usage limits or security measures
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization
• Use automated means to access the Service excessively
• Interfere with or disrupt the Service

Content and Intellectual Property

Your Content

You retain all rights to the content you input into the Service ("Input") and the content generated by the Service based on your Input ("Output"). You are responsible for ensuring your Input complies with these Terms and applicable laws.

Our Service

The Service, including its original content, features, and functionality, is owned by ARKA AI and is protected by copyright, trademark, and other intellectual property laws.

License to Use

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes, subject to these Terms.

Third-Party Services

Our Service integrates with third-party AI providers (Anthropic, OpenAI) and other services (Slack, GitHub, Google, etc.). Your use of these integrations is subject to their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We process your data as described in our Privacy Policy, including:

• Sending your prompts to third-party AI providers for processing
• Storing conversation history for service delivery
• Analyzing usage data to improve the Service
• Sharing data with integrated third-party services as authorized by you

Disclaimers and Limitations

Service Availability

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted or error-free service. We may suspend or terminate the Service for maintenance or other reasons.

AI-Generated Content

AI-generated outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying all AI-generated content before use. We are not liable for any decisions made based on AI outputs.

Limitation of Liability

To the maximum extent permitted by law, ARKA AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service.

Indemnification

You agree to indemnify and hold harmless ARKA AI from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Request from law enforcement

You may cancel your subscription at any time through your account settings. Upon termination, your right to use the Service will immediately cease.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
