AI GlowUp — Terms of Service

These Terms of Service (“Terms”) govern your use of the AI GlowUp mobile application (“the App”) operated by Arka AI (“we,” “us,” or “our”). By downloading, installing, or using AI GlowUp, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
AI GlowUp is a profile photo optimization tool that provides AI-powered photo quality analysis, multi-photo ranking, and optional AI-generated photo enhancements. The App evaluates photo quality, composition, and presentation effectiveness — it does not rate attractiveness, perform facial recognition, or identify individuals.
2. Eligibility
You must be at least 17 years old to use AI GlowUp. By using the App, you represent and warrant that you meet this age requirement.
3. User Accounts
You may sign in using Sign in with Apple. You are responsible for maintaining the security of your account and device. We are not liable for any loss arising from unauthorized access to your account.
4. Acceptable Use
You agree not to:
- •Upload photos of individuals without their consent
- •Upload content that is illegal, obscene, threatening, defamatory, or that infringes on the rights of others
- •Attempt to circumvent content moderation, rate limits, or security measures
- •Use the App for any unlawful purpose or in violation of any applicable laws
- •Reverse-engineer, decompile, or attempt to extract the source code of the App or its backend services
- •Use automated tools, bots, or scripts to access or interact with the App
- •Resell, redistribute, or sublicense access to the App or its features
We reserve the right to suspend or terminate your access if you violate these Terms.
5. Photo Data and AI Processing
By using the App's analysis, ranking, or enhancement features, you acknowledge and agree that:
- •Your photos will be transmitted to our servers and processed by third-party AI services (Google Gemini via OpenRouter, with OpenAI GPT-4o as a fallback)
- •Photos are processed in real-time and original photos are not stored on our servers
- •AI-generated enhancement images are stored in our database so you can retrieve them
- •Analysis results (scores and text feedback) are stored until you delete your account
- •All uploaded photos are subject to automated content moderation and may be rejected

6. Subscriptions and Purchases
6.1 AI GlowUp Pro
AI GlowUp offers a Pro subscription with weekly and annual billing options. Subscriptions are billed through Apple's App Store and are subject to Apple's terms and conditions.
6.2 Credit Packs
AI GlowUp offers one-time credit pack purchases for enhancement features. Credits are non-transferable and have no cash value.
6.3 Billing and Renewal
- •Subscription payments are charged to your Apple ID account at confirmation of purchase
- •Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
- •Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate
- •You can manage and cancel subscriptions in your Apple ID Account Settings
6.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels at reportaproblem.apple.com. We do not process refunds directly.
6.5 Free Tier
Free users receive limited daily usage (analyses, rankings, and enhancements). These limits reset daily and may be adjusted at our discretion.
7. Intellectual Property
7.1 Our Content
The App, including its design, code, AI models, prompts, scoring algorithms, and branding, is the property of Arka AI and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the App.
7.2 Your Content
You retain ownership of the photos you upload. By uploading photos, you grant us a limited, non-exclusive license to process them solely for the purpose of providing the App's services (analysis, ranking, enhancement). This license terminates when you delete your data or account.
7.3 AI-Generated Content
AI-generated enhancement images are created for your personal use. You may use, save, and share your generated images freely. We do not claim ownership of AI-generated images produced from your photos.
8. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Specifically:
- •AI analysis scores and coaching tips are subjective assessments generated by AI and should not be taken as definitive or professional advice
- •We do not guarantee that using the App will improve your profile performance on any platform
- •AI-generated enhancements may not always meet your expectations
- •Service availability may be interrupted for maintenance or due to factors beyond our control
- •Analysis results may vary between sessions due to the nature of AI processing
9. Limitation of Liability
To the maximum extent permitted by law, Arka AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Arka AI from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your account and data at any time via Account → Delete My Data.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
