By using ARKA-AI, you agree to these terms. Please read them carefully before using our service.
1. Acceptance of Terms
By accessing or using ARKA-AI ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.
We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
2. Service Description
ARKA-AI is an AI workspace that provides intelligent routing of requests to various AI models. The Service uses our proprietary ARKAbrain technology to select optimal models for different tasks.
The Service operates on a Bring Your Own Key (BYOK) model, meaning you provide your own API keys from AI providers (OpenAI, OpenRouter, etc.) to use the Service.
3. Your API Keys (BYOK)
Your Responsibility: You are solely responsible for:
- • Obtaining and maintaining valid API keys from providers
- • Ensuring your API usage complies with provider terms
- • Managing and monitoring your API costs
- • Keeping your API keys secure
- • All activity that occurs using your API keys
Our Responsibility: We encrypt and securely store your API keys, use them only to fulfill your requests, and never share them with third parties.
Important: ARKA-AI is not responsible for charges incurred through AI providers. You pay providers directly based on your usage.
4. Prohibited Uses
You may not use the Service to:
- • Generate illegal, harmful, or malicious content
- • Violate any applicable laws or regulations
- • Infringe on intellectual property rights
- • Harass, abuse, or harm others
- • Attempt to gain unauthorized access to our systems
- • Circumvent rate limits or usage restrictions
- • Resell or redistribute the Service without permission
- • Use automated systems to scrape or extract data from the Service
Violation of these terms may result in immediate termination of your account.
5. Subscription & Billing
Plans: ARKA-AI offers Starter and Pro subscription plans with different features and limits. Current pricing and features are displayed on our pricing page.
Billing: Subscriptions are billed monthly. You authorize us to charge your payment method on a recurring basis until you cancel.
Cancellation: You may cancel your subscription at any time. You will retain access until the end of your current billing period.
Refunds: Subscription fees are generally non-refundable. Contact us for exceptional circumstances.
6. Limitations & Disclaimers
AI-Generated Content: AI outputs may contain errors, inaccuracies, or biased content. You are responsible for reviewing and verifying any content before use.
Service Availability: We strive for high availability but do not guarantee uninterrupted service. The Service depends on third-party AI providers which may experience outages.
Warranty Disclaimer: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKA-AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
7. Intellectual Property
Our Property: ARKA-AI, ARKAbrain, and related trademarks, logos, and technology are our property. You may not use these without permission.
Your Content: You retain ownership of content you input into the Service. You grant us a license to process this content solely to provide the Service.
AI Outputs: Ownership of AI-generated outputs is subject to applicable law and the terms of the underlying AI providers.
8. Termination
You may terminate your account at any time by contacting us or through your account settings.
We may suspend or terminate your account if you violate these terms, engage in prohibited activities, or fail to pay subscription fees.
Upon termination, your right to use the Service ends. We may delete your data in accordance with our Privacy Policy.
9. Governing Law
These terms are governed by the laws of the jurisdiction in which ARKA-AI operates. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction.
