ActionScan — Terms of Service

These Terms of Service (“Terms”) govern your use of the ActionScan mobile application (“the App”) operated by Arka AI (“we,” “us,” or “our”). By downloading, installing, or using ActionScan, you agree to these Terms. If you do not agree, do not use the App.
1. Description of Service
ActionScan is an AI-powered document and object scanning application. The App provides document scanning with OCR, object capture, AI Scan, Live Insight (real-time camera AI analysis), and Batch Scan modes. AI-powered features include document summarization, data extraction, translation, contract risk analysis, form assistance, knowledge capture, and conversational AI chat about your documents. The App also supports digital signatures, smart folders with auto-filing, and PDF export. All AI-generated content is provided as informational assistance and should be verified independently for critical decisions.

ActionScan does not provide legal, financial, or professional advice. AI analysis is for informational purposes only.

3. Eligibility
You must be at least 17 years old to use ActionScan. By using the App, you represent and warrant that you meet this age requirement.
4. Acceptable Use
You agree not to:
- •Scan or process documents you do not have legal authority to access
- •Use the App to forge, alter, or misrepresent documents or signatures
- •Attempt to circumvent credit limits, subscription systems, or security measures
- •Reverse-engineer, decompile, or attempt to extract the source code of the App or its backend services
- •Use automated tools, bots, or scripts to access or interact with the App
We reserve the right to suspend or terminate your access if you violate these Terms.
5. Document Data and AI Processing
By using the App's AI features, you acknowledge and agree that:
- •Your scanned document text and images will be transmitted to our servers and processed by third-party AI services (Anthropic Claude via OpenRouter)
- •Document content is processed in real-time and is not stored on our servers after processing is complete
- •AI insights and chat responses are stored locally on your device
- •Your data is never used to train AI models
- •AI-generated analyses are for informational purposes — you are responsible for verifying results independently

6. Subscriptions and Credits
6.1 Credit System
ActionScan uses a credit-based system for AI actions. Each AI action consumes a specified number of credits. Free users receive a limited number of credits. Additional credits can be purchased or obtained through subscription plans.
6.2 Subscription Plans
Subscriptions are available as auto-renewing monthly or annual plans through Apple's App Store. All purchases are processed by Apple and are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
6.3 Credit Packs
One-time credit packs may be purchased as non-consumable in-app purchases. Credits do not expire as long as your account remains active.
6.4 Refunds
All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels at reportaproblem.apple.com. We do not process refunds directly.
7. Intellectual Property
7.1 Our Content
The App, including its design, code, AI prompts, analysis algorithms, and branding, is the property of Arka AI and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the App.
7.2 Your Content
You retain ownership of all documents, images, and data you scan or create. By using AI features, you grant us a limited, non-exclusive license to process your content solely for providing the requested analysis. This license terminates when processing is complete.
7.3 AI-Generated Content
AI-generated summaries, analyses, risk assessments, and chat responses are provided for your personal use. You may use, share, and export these results. You are solely responsible for how you act on any AI-generated content.
8. Disclaimers
The App is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

- •Contract risk scores are approximate and do not replace professional legal review
- •Service availability may be interrupted for maintenance or due to factors beyond our control
9. Limitation of Liability
To the maximum extent permitted by law, Arka AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, reliance on AI-generated analyses, or errors in OCR extraction.
Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Arka AI from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your reliance on any AI-generated content provided by the App.
11. Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may delete your data at any time by removing scans or uninstalling the App. Unused credits are not refundable upon termination.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the “Last Updated” date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
